INSURER PAYS DAMAGES FOR FAILURE TO PROVIDE DEFENSE
A contractor who was sued as a result of faulty work by one of his subcontractors received an award of damages from his insurer who failed to provide a defense. The contractor contacted several law firms when he was sued by a homeowner he was building a house for. His insurer refused to provide a defense pursuant to the terms of the policy. The Law Offices of John J. Mattey accepted the case and sued the insurer on his behalf. The insurer eventually paid the homeowner for his part in the underlying claim and paid damages to the contractor for their failure to provide a defense.
FIRM SETTLES MULTI-MILLION DOLLAR CASE AGAINST INSURER
An insurance company settled a multi-million dollar claim for its failure to pay the business losses of a company whose building was destroyed in a fire. The insurer initially argued that the insured had intentionally under-insured its property. However, during the course of litigation, The Law Offices of John J. Mattey discovered that the agent was not authorized to write the type of policy at issue and that the agent had mishandled the application process. The insured recovered the full value of their loss and damages for bad faith breach of contract.
SUCCESS CANNOT ALWAYS BE MEASURED IN TERMS OF DOLLARS & CENTS
A young man was seriously injured when he was struck by a vehicle while riding his skateboard in the roadway. The investigating officer cited the young man. The insurer for the driver denied the paralyzed young man’s claim for damages. His parents hired two separate firms to assist them. Unfortunately, neither one was able to convince the insurer to tender their policy limits. The Law Offices of John J. Mattey accepted the case and shortly thereafter convinced the carrier to tender its insured’s policy limits. Sadly, the driver’s policy limits were minuscule in light of the young man’s injuries.
